Illinois Woman Sues Starbucks Because Of Too Much Ice

CHICAGO, May 2 (UPI) — An Illinois woman is suing Starbucks for $5 million because she said her coffee has too much ice and not enough liquid.

Stacy Pincus filed her class-action suit in federal court in Chicago last week.

In her suit, she says Starbucks engages in “false and misleading marketing and sale of cold drinks.”

On its menu, the suit says, “Starbucks advertises all of its drinks, including its cold drinks, by fluid ounce. As detailed herein, a Starbucks customer who orders and pays for a cold drink receives much less than advertised — often nearly half as many fluid ounces.”

The suit continued, “Starbucks’ cold drinks are underfilled to make more money and higher profits, to the detriment of consumers who are misled by Starbucks’ intentionally misleading advertising practices.”

In the suit, she says the 24-ounce venti-sized drink contains 10 ounces of ice.

The suit suggests Starbucks use larger cups to sell the advertised amount of drinks.

The suit was filed on behalf of customers who brought a cold drink at Starbucks in the past 10 years.

Hart McLaughlin & Eldridge LLC in Chicago is representing Pincus.

Starbucks spokeswoman Jaime Riley told NBC News that Pincus’ claims are “without merit.”

“Our customers understand and expect that ice is an essential component of any ‘iced’ beverage,” Riley said. “If a customer is not satisfied with their beverage preparation, we will gladly remake it,” she added.
