Legislative agenda item reveals settlement close in UDOT case against Timpanogos Highway contractor

SALT LAKE CITY, Utah, Sept. 15, 2017 (Gephardt Daily) — A proposed settlement has been reached between the Utah Department of Transportation and Flatiron/Harper Joint Venture in a $29.4 million case filed in 2012.

The UDOT lawsuit accused the contractor of poor construction and design practices in building State Route 92 — the Timpanogos Highway — between Lehi and Alpine. Also at issue was $4.5 million in late fees UDOT said the contractor owed after finishing the troubled project 10 months late.

No announcement has been made regarding the settlement or its amount, but an agenda released for the Utah Legislative special session reveals that settlement approval is one of four items to be considered.

The Legislature’s special session is scheduled to begin at 2 p.m. Wednesday.

The settlement approval appears as No. 2 on the agenda, released Friday by the office of Utah Gov. Gary Herbert.
