North Salt Lake police: Suspect arrested after biting off ‘large chunk’ of man’s ear

NORTH SALT LAKE, Utah, Jan 2, 2019 (Gephardt Daily) — A man was arrested and is facing multiple felony charges after he allegedly bit off part of another man’s ear on New Year’s Day.

Brian David Boyack, 43, was involved in an altercation following a dispute about large corporations and conspiracy theories, according to a probable cause statement filed Tuesday in 2nd District Court in Farmington.

In the statement, North Salt Lake Police Officer Tyler Weir said he made contact with the victim, referred to as MB, at the University of Utah Hospital, where MB was being treated for a serious injury to his ear, “which was missing a large chunk of flesh
from the top of it.”

MB told the officer that several people, including Boyack, had been out in the hot tub having a good time when the conversation turned to “big corporations and essentially conspiracy theories.”

Boyack had been drinking, MB told the officer. Boyack allegedly took issue with the fact that MB works in the banking business. A heated argument ensued, and Boyack began to pack up his belongings and put them in a vehicle.

MB said he had locked Boyack outside because he was “acting crazy,” and he also was worried that Boyack might try to drive after drinking.

Boyack allegedly began hitting the windows in the front of the house with a patio chair, breaking the chair. That’s when MB opened the front door to tell him to stop damaging the house, and he and Boyack got into a physical altercation.

MB said Boyack attacked him and held him to the ground. As MB was trying to push him away, Boyack bit his ear “very hard,” MB told the officer.

MB’s wife witnessed the incident and spoke with a different officer. Her account corroborated what MB had told Weir.

Boyack fled in his truck before police arrived at the house, and multiple officers searched the area, but Boyack wasn’t located, according to the probable cause statement.

Later, Boyack turned himself in at the police station and was taken into custody. He was advised of his Miranda Rights and said, “I’ve done something horrible but I don’t want to answer questions.”

According to a note in the statement, the altercation took place in front of three juveniles.

Boyack is facing charges of:

  • Mayhem, a second-degree felony
  • Criminal mischief, a class B misdemeanor
  • Intoxication, a class C misdemeanor
  • Three counts of domestic violence in the presence of a child, a third-degree felon
