ROY, Utah, June 11, 2019 (Gephardt Daily) — A Roy teen was arrested Monday after he allegedly beat his father during an altercation over a cellphone.
A probable cause statement from the 2nd District Court in Ogden said Koby Leo-Curtis Burton, 18, is facing charges of assault with substantial bodily injury, a class A misdemeanor; interruption/interference of a communications device, a class B misdemeanor; and purchase or possession of tobacco by a minor, an infraction.
The arresting officer wrote in the probable cause statement that he responded to an address in Roy on a report of an assault at approximately 1:20 a.m. Monday.
“I arrived and made contact with the victim on initial contact I observed an obvious serious injury to his right eye; the eye was severely swollen, black and had a cut just below the eye,” the statement said.
“The victim advised that his son, Koby Burton, during an argument over his phone being turned off became angry and assaulted him by punching him between five and 10 times, causing the injury.”
The officer then made contact with Koby Burton at a nearby Maverik gas station and he admitted to “losing it” and hitting his father multiple times in the face with a closed fist, the statement said.
“He also admitted that prior to the assault and during the argument he took the victim’s phone from him as he was attempting to call police for assistance because he did not want police involved,” the statement said.
Once placed under arrest, a search incident to arrest was conducted on Burton’s backpack he was carrying and a pack of cigarettes and an e-cigarette were located in this bag. Burton admitted to the tobacco being his.
The suspect was transported to Weber County Jail with his bail set at $2,690.
