Man arrested after allegedly assault, brandishing gun at driver, fleeing Clearfield police

CLEARFIELD, Utah, May 18, 2024 (Gephardt Daily) — A 23-year-old driver has been booked into the Davis County jail after allegedly punching a man and brandishing a firearm, then fleeing police and damaging property, all while intoxicated.

Clearfield Police officers were called to the area of 19 N. Main on a suspected DUI in which the driver reportedly brandished handgun at the complainant. The man later taken into custody was identified as Adrian James-Gabriel Rivas.

The police response began after the alleged victim called dispatch.

“The complainant advised Adrian was the only occupant in the vehicle and was swerving on I-15,” says the affidavit filed in the arrest of Rivas.

“Adrian had pulled into the Baskin-Robbins and engaged in fighting. Adrian got out of his vehicle and approached a red truck in the parking lot. Adrian hit the male driver through the driver side window. Adrian then got back in his vehicle and drove to 19 N. Main.”

There, Rivas parked his vehicle in a stall, the police statement says. He entered an apartment, and when he came back out, an officer had parked behind him so he could not leave.

“Adrian was actively resistant and got back into his vehicle. Adrian put his vehicle in reverse and hit the complainant’s vehicle and an officer’s vehicle, then put the vehicle in drive. Adrian drove on the sidewalk by the apartment complex and hit a handicap sign, two more vehicles, and almost hit a pedestrian going at a high rate of speed,” the Clearfield Police statement says.

Rivas reportedly caused more property damage, and drove on sidewalks and curbs in an attempt to get away from police, who had patrol car lights and sirens activated. Ultimately, officers hit Rivas’ vehicle, which was traveling at a high rate of speed. The vehicle hit a pole, and Rivas was cuffed and arrested.

An evidence inventory cited in the probable cause statement turned up a firearm with a bullet in the chamber, located on the front passenger side, amphetamine, dextroamphetamine and a marijuana pipe.

Rivas was arrested Friday evening for investigation of:

  • Aggravated assault, a third-degree felony
  • Possession of a dangerous weapon by a restricted person, a third-degree felony
  • Failure to stop at command of law enforcement, a class A misdemeanor
  • Property damage/destruction — loss of $500 to $1,499, a class A misdemeanor
  • Possession of a controlled substances schedule I/II/analog, a class A misdemeanor
  • Assault, a class B misdemeanor
  • Interfering with a peace officer, a class B misdemeanor
  • Alcohol restricted driver, a class B misdemeanor
  • Driving under the influence, first offense in 10 years, a class B misdemeanor
  • Reckless driving, a class B misdemeanor
  • Six counts of failure to comply with duties at vehicle accident/property damage, a class B misdemeanor
  • Ignition interlock violation, a class C misdemeanor
  • Driving on suspended or revoked license, a class C misdemeanor
  • Operating vehicle without insurance, a class C misdemeanor
  • Disorderly conduct fighting/violent, tumultuous behavior, an infraction

Rivas was ordered held without bail.
