CLINTON, Utah, May 6, 2024 (Gephardt Daily) — A 34-year-old man was arrested Sunday following a shooting in Clinton after he reportedly told police he “intentionally tried to kill the victim by shooting him three times.”
Toby Anthony Rodriguez was jailed for investigation of:
- Murder (attempted), a first-degree felony
- Three counts of felony discharge of a firearm, as a first-, second- and third-degree felony
- Three counts of purchase, transfer, possession or use of a firearm by a restricted person, a third-degree felony
- Use or possession of drug paraphernalia, a class B misdemeanor
Charging documents filed after the Sunday incident say officers were dispatched on a gunshot wound in the area of 1000 North and 700 West. The shooting victim was located at a neighbor’s residence with gunshot wounds to the abdomen and ear.
Rodriguez was located near a vehicle, holding a shotgun in hand, and was taken into custody and placed into a patrol car, the Clinton police statement says.
“While inside the vehicle, a drug pipe was located after opening the door to give the suspect water,” Rodriguez’s affidavit says. “The pipe was on the street below the suspect.”
At the police station, “He admitted to a detective that he had consumed a large amount of marijuana and alcohol. The suspect and victim were looking at weapons in the home that the suspect said he legally owns. He had a long rifle, a shotgun, and a handgun.”
Rodriguez “admitted to the detective that he had intentionally tried to kill the victim by shooting him three times with the handgun. A round hit the victim in the abdomen causing serious bodily injury, another round hit him in the ear causing bodily injury, and a third round was fired in the victim’s direction.”
The shooting victim was interviewed after surgery at Mckay Dee Hospital, “and informed a detective that the suspect had fired multiple rounds at him hitting him in the abdomen and the ear.”
Rodriguez is being held without bail at the Davis County jail.
