OGDEN, Utah, Jan. 23, 2017 (Gephardt Daily) — A Pleasant View man was sentenced on Monday after he pleaded guilty last month to causing the death of his infant son in 2015.
Krystopher Mikehal Cleary, 22, was sentenced to 15 years to life in prison in the death of Kyson Mikehal Cleary.
The baby was 16 days old when he was critically injured and flown by Life Flight to Primary Children’s Hospital for emergency treatment. Kyson was 20 days old when he died.
According to a probable cause statement, Cleary told officers after being read his Miranda Rights that he and his wife had “tried everything they could think of” to get the newborn to stop crying.
Cleary said his wife left the room, and he decided to change the baby’s diaper. He was holding the boy when he heard the clavicle bone “pop,” he said.
“Krystopher said the baby then went stiff and turned purple and quit breathing,” the statement said.
Cleary told his wife what had happened, and said the two of them ran the baby upstairs to his wife’s mother, who performed rescue breathing until paramedics arrived.
“Doctors discovered he (baby Kyson) had suffered traumatic injuries to his head, eyes, and had a broken clavicle bone,” the probable cause statement said.
“Doctors advised the injuries were unsurvivable. Doctors also confirmed that there is no plausible accidental mechanism such as a fall or drop that would account for the injuries.”
Judge Joseph Bean, Second District Court, also ordered that Cleary pay at least $1,310 in restitution, an amount that could increase as the infant’s medical bills are settled.
