Charges filed against Millcreek teen accused in brother’s fatal shooting

MILLCREEK, Utah, Aug. 10, 2019 (Gephardt Daily) — A Millcreek man was charged Friday with manslaughter in the shooting death of his younger brother.

Emilio Madrigal-Rios, 19 and a police-documented gang member, was charged Friday in 3rd District Court on suspicion of:

  • Manslaughter, a first-degree felony
  • Carrying a concealed dangerous weapon, a first-degree felony
  • Obstruction of justice, a second-degree felony

According to a probable cause statement filed by an officer of the Unified Police Department, officials responded on June 21 of this year to the area of 4900 E. Millcreek Road after the report of a suspicious death.

The 17-year-old brother of Madrigal-Rios, identified in court papers as C.M-R., was found deceased with a gunshot to his right cheek. A black semi-automatic handgun was located in bushes to the north of the body.

Suspect Madrigal-Rios was found with blood on his hands, shirt, pants and shoes.

“Post-Miranda, Madrigal-Rios admitted arguing with C.M-R. and struggling with him over a gun that he concealed for C.M-R. in the pocket of his jacket,” the probable cause statement says.

“Madrigal-Rios stated that during the struggle, the gun went off and C.M-R. fell to the ground. Madrigal-Rios stated he picked up the gun and threw it away from the scene.”

An autopsy’s preliminary findings stated that C.M-R.’s cause of death was a gunshot wound to the head, which penetrated his spine.

A warrant has been issued for Madrigal-Rios’ arrest. His bail is set at $500,000. As of early Saturday afternoon, Madrigal-Rios had not yet been booked into the Salt Lake County Jail.
