TAYLORSVILLE, Utah, May 11, 2024 (Gephardt Daily) — Taylorsville police arrested a 24-year-old man Friday after an alleged road rage incident at a gas station.
A Taylorsville Police officer was in the area of the Speedway at 4800 S. Redwood Road at about 8:08 p.m. when he heard a female screaming, says a police report filed in the arrest of Victor Dale Lujan. The officer pulled up to the gas station and found two men, who had arrived in separate vehicles, in a physical fight.
“I immediately exited my truck, yelled at both male to stop,” and radioed for backup, the officer said in Lujan’s probable cause statement. The officer ordered the men to separate and sit about 20 feet apart on the curb.
One man that was fighting had been holding something like a metal club. The woman who had been screaming said her boyfriend was the man with the club, and the other man had followed them to the gas station and attacked them. Her boyfriend pulled out a club for self-defense, striking Lujan.
Lujan said, post Miranda, that the road rage incident was his fault.
The female victim then said she had seen a gun in Lujan’s waistband. He was immediately cuffed, and a pistol was found on the right side of his waist. The gun was loaded with 17 rounds, but had no bullet in the chamber. In the vehicle Lujan has been driving, officers found a backpack with marijuana in a gallon bag, then packaged in six smaller containers. Empty plastic bags and a scale also were found.
Post Miranda, Lujan told officers he was behind the other man on Redwood Road when the man in the first car began throwing his arms up and yelling, “which was making Lujan angry,” the affidavit said. Lujan said he stopped to confront the man in the first car.
“They began to fight. Lujan said it was his fault and he takes responsibility for it,” the affidavit says. “I asked about his pistol, he said he didn’t take it out, but he could feel it moving around in his waistband, so he grabbed it and pushed it down but did not take it out.”
Lujan told the officer he had the pistol for protection, and said his supply of marijuana was mostly for him, but he also sold it.
Lujan was ordered held without bail for investigation of:
- Category I restricted person transaction, firearm, a second-degree felony
- Category II, restricted person transaction, firearm, a third-degree felony
- Possession with intent to distribute a controlled substances, a third-degree felony
- Two counts of assault, a class B misdemeanor
He was ordered held without bail.
